Terms of Service

These Terms of Service ("Agreement") govern your access to and use of the Ankos compliance platform, including the web application, API, CLI tool, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by this Agreement.

1. Account Registration & Security
To use the Service, you must create an account with a valid email address and maintain accurate, complete account information. You are responsible for safeguarding your account credentials, including passwords and API keys.
You must immediately notify Ankos at legal@ankos.dev if you become aware of any unauthorized use of your account. Ankos is not liable for any loss or damage arising from your failure to maintain the security of your account credentials.
You must be at least 18 years of age or the age of legal majority in your jurisdiction to create an account. By creating an account on behalf of an organization, you represent that you have the authority to bind that organization to this Agreement.
2. Subscription Plans & Billing
2.1 Plans
Ankos offers a free CLI tier and paid subscription plans. The features and pricing for each plan are described on our Pricing page. Ankos reserves the right to modify plan features and pricing with 30 days' prior notice.
2.2 Billing & Auto-Renewal
Paid subscriptions are billed either monthly or annually, as selected at the time of purchase. All subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date. You authorize Ankos to charge your payment method on file for recurring subscription fees.
2.3 Free Trial
New accounts may be eligible for a free trial period. At the end of the trial, your subscription will convert to a paid plan unless you cancel. You will not be charged during the trial period.
2.4 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of that period. After cancellation, your account reverts to read-only access to historical data.
2.5 Refunds
Annual subscriptions are eligible for a prorated refund if cancelled within 30 days of the initial purchase or renewal. Monthly subscriptions are not eligible for refunds. Refund requests should be sent to legal@ankos.dev.
2.6 Taxes
All fees are exclusive of taxes. You are responsible for all applicable taxes, and Ankos will charge tax where required by law.
3. Acceptable Use
You agree to use the Service only for lawful purposes related to managing your organization's PCI DSS compliance evidence. You agree not to:
- Use the Service to store, transmit, or process actual cardholder data (PANs, CVVs, or other sensitive authentication data).
- Attempt to gain unauthorized access to other users' accounts, data, or organizations.
- Reverse-engineer, decompile, or disassemble any portion of the Service.
- Use the Service to develop a competing product or service.
- Circumvent any usage limits, access controls, or security measures.
- Use automated means to access the Service in a manner that exceeds reasonable request volumes.
- Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
4. Data Ownership
4.1 Your Data
You own your data. All evidence files, compliance records, scan results, and other content you upload or generate through the Service ("Your Data") remains your property. Ankos does not claim any ownership rights over Your Data.
4.2 License to Provide Service
You grant Ankos a limited, non-exclusive license to store, process, and display Your Data solely to provide and improve the Service. This includes generating evidence summaries, organizing evidence by categories, and producing evidence export packages.
4.3 No Secondary Use
Ankos will not sell, share, or use Your Data for advertising, AI model training, or any purpose unrelated to providing the Service. Your compliance evidence is sensitive — we treat it accordingly.
4.4 Data Export
You may export Your Data at any time through the Service's export functionality or API. Upon account termination, you will have a grace period to export Your Data as described in Section 7.
5. Service Level
5.1 Availability
Ankos strives to maintain high availability for the web application and API. This excludes scheduled maintenance windows and circumstances beyond our reasonable control.
5.2 Maintenance
Ankos may perform scheduled maintenance that temporarily affects Service availability. We will provide at least 24 hours' notice for planned maintenance via email or in-app notification.
5.3 Support
Support availability varies by plan. Free CLI users have access to community support and documentation. Team plan subscribers receive email support with a target response time of one business day. Enterprise customers receive priority support as specified in their service agreement.
6. Compliance & Security
6.1 Our Practices
Ankos implements industry-standard security measures to protect Your Data, including encryption at rest (AES-256), encryption in transit (TLS 1.2+), access controls, and audit logging. For more details, see our Security page.
6.2 Your Responsibility
You are responsible for the accuracy and completeness of evidence you upload or attest to. You are responsible for maintaining the security of your account credentials and AWS credentials used with the CLI. You are responsible for ensuring your use of the Service complies with your organization's policies and applicable regulations.
6.3 Ankos Is a Tool, Not a Guarantee
Ankos is a compliance evidence management tool. It is not a Qualified Security Assessor (QSA) and does not make compliance determinations. Use of Ankos does not guarantee PCI DSS compliance. Your QSA makes the final determination of compliance status. Ankos helps you collect, organize, and present evidence — the QSA evaluates it.
7. Termination
7.1 Your Right to Cancel
You may cancel your account and terminate this Agreement at any time through your account settings or by contacting legal@ankos.dev.
7.2 Our Right to Terminate
Ankos may suspend or terminate your account if you materially breach this Agreement, including violation of the Acceptable Use terms, non-payment of fees after reasonable notice, or if required to do so by law. We will provide reasonable notice where possible.
7.3 Data Export Period
Upon termination (whether by you or by Ankos), you will have a reasonable period to export Your Data. After this period, Ankos will delete Your Data from active systems in accordance with our data retention policy.
7.4 Survival
Sections relating to data ownership, limitation of liability, indemnification, and dispute resolution survive termination of this Agreement.
8. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ANKOS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
ANKOS DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY EVIDENCE SUMMARIES, SCAN RESULTS, OR GUIDANCE PROVIDED THROUGH THE SERVICE. SUCH OUTPUTS ARE FOR INFORMATIONAL PURPOSES AND DO NOT CONSTITUTE LEGAL OR COMPLIANCE ADVICE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ANKOS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Service;
- Any conduct or content of any third party on the Service;
- Any evidence, scan results, or guidance obtained from the Service;
- Unauthorized access, use, or alteration of your data or transmissions;
- Any compliance determination or assessment outcome.
ANKOS'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ANKOS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
10. Indemnification
You agree to indemnify, defend, and hold harmless Ankos, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service;
- Your violation of this Agreement;
- Your violation of any third-party rights;
- Any content you upload or submit through the Service;
- Any compliance representations you make based on Service outputs.
11. Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
Any dispute arising out of or relating to this Agreement or the Service shall first be attempted to be resolved through good-faith negotiation between the parties for a period of 30 days. If the dispute cannot be resolved through negotiation, either party may pursue resolution in the federal or state courts located in Delaware.
You agree that any claim or cause of action related to the Service must be filed within one (1) year after the claim arose, or be permanently barred.
12. Modifications to Service
Ankos reserves the right to modify, suspend, or discontinue any part of the Service at any time. We will provide at least 30 days' notice before discontinuing material features or the Service as a whole, and will provide a reasonable data export period.
13. Changes to Terms
Ankos may update this Agreement from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated terms. If you do not agree to the changes, you must cancel your account before the effective date.
